  1. GENERAL INFORMATION

 

1.1 Corporate Name and Company Information

My Peru Destinations is a luxury tourism corporation legally domiciled in Peru, duly registered with the competent Peruvian authorities. These Terms and Conditions (hereinafter “T&C”) govern the contractual relationship between My Peru Destinations (hereinafter “the Company”) and the client (hereinafter “the Client”) for the provision of tourism services in Peru, Bolivia, and Ecuador.

1.2 Acceptance of the Terms

By making a reservation with My Peru Destinations, the Client expressly accepts these T&C in full. The reservation confirmation constitutes a binding contract between both parties under Peruvian law.

1.3 Scope of Application

These T&C apply exclusively to My Peru Destinations as a corporate entity. Each specialized agency within our corporation maintains its own independent operational policies.

 

  1. RESERVATIONS AND CONFIRMATION

 

2.1 Reservation Process

  • Reservations may be made via email, telephone, website, or through our authorized representatives.
  • All reservations require completion of the client information form with accurate and truthful data.
  • The Company reserves the right to request additional documentation to verify the Client’s identity.

2.2 Reservation Confirmation

A reservation is only considered confirmed after:

  • Receipt of the required initial deposit
  • Written confirmation issued by My Peru Destinations
  • Verified availability of all contracted services

The Client will receive a reservation voucher detailing the services, dates, prices, and applicable conditions.

2.3 Availability

  • Services are subject to availability at the time of confirmation.
  • The Company does not guarantee availability until the deposit is received and formal confirmation is issued.
  • If a service is unavailable, equivalent or superior alternatives will be offered, or the deposit will be fully refunded.

 

  1. PRICES AND PAYMENTS

 

3.1 Currency and Prices

  • All prices are expressed in U.S. dollars (USD) unless otherwise indicated.
  • Prices include only the services specifically detailed in the confirmed itinerary.
  • Prices are subject to change until the reservation is confirmed through payment of the deposit.

3.2 Payment Structure

Initial Deposit:

  • 30% of the total package value at the time of booking
  • Non-refundable in case of cancellation by the Client

Final Payment:

  • Remaining 70% due at least 60 days before the start date
  • For bookings made within 60 days of departure, full payment is required immediately

3.3 Accepted Payment Methods

  • International bank transfer
  • Credit cards (3.5% processing fee may apply)
  • PayPal (processing fee may apply)
  • Other methods upon prior coordination

3.4 Excluded Surcharges

Unless expressly stated, the following are NOT included:

  • International flights to/from Peru
  • Personal expenses, tips, and gratuities
  • Alcoholic beverages not specified
  • Travel insurance (strongly recommended)
  • Services not mentioned in the itinerary
  • Local tourism taxes where applicable

 

  1. CANCELLATION AND REFUND POLICIES

 

4.1 Cancellation by the Client

  • More than 90 days before start: 30% retained (initial deposit)
  • Between 89 and 60 days: 50% of total value retained
  • Between 59 and 30 days: 75% retained
  • Less than 30 days: No refund (100% retained)

4.2 No-Show

Failure to appear on the start date without prior cancellation results in total forfeiture of payment (100% retained) with no refund.

4.3 Cancellation by My Peru Destinations

If the Company must cancel due to operational reasons:

  • 100% refund of payments made, or
  • Rescheduling at no additional cost for alternative dates, or
  • An alternative package of equivalent or superior value

4.4 Itinerary Modifications by the Client

  • Modification requests are subject to availability and additional costs.
  • Requests made more than 60 days in advance: possible without administrative fee.
  • Requests within 60 days: 15% administrative fee.
  • Date changes may be considered cancellations and new bookings.

4.5 Force Majeure

In cases of force majeure (natural disasters, pandemics, war, government restrictions, etc.):

  • No cancellation penalties apply.
  • Rebooking or a voucher valid for 24 months will be offered.
  • Refunds will follow the terms recoverable from third-party providers.
  • The Company is not responsible for additional expenses incurred by the Client.

 

  1. RESPONSIBILITY FOR THIRD-PARTY SERVICES

 

5.1 Nature of the Company as Intermediary

The Company acts as an intermediary when contracting third-party services, including but not limited to:

  • Hotels (including Belmond Hotels and other luxury properties)
  • Train services (luxury trains)
  • River cruises (Amazon River Cruises)
  • Domestic air and land transportation
  • Restaurants and culinary services
  • Tour guides and activity operators

5.2 Limitation of Liability

  • The Company assumes no responsibility for acts, omissions, negligence, or breaches by third-party providers.
  • Each provider operates under its own terms and conditions.
  • The Company will facilitate claims but does not assume direct responsibility for services provided by third parties.

5.3 Quality Standards

  • The Company selects high-quality providers consistent with the luxury segment.
  • Regular inspections are conducted, but the Company does not directly control third-party operations.
  • The Client accepts that variations in standards may occur and are outside the Company’s control.

5.4 Claims

  • Complaints about third-party services must be reported immediately to the guide or Company representative.
  • The Company will make its best efforts to resolve issues on site.
  • Post-trip claims must be submitted in writing within 30 days of trip completion.

 

  1. TRAVEL INSURANCE

 

6.1 Strong Recommendation

My Peru Destinations strongly recommends full international travel insurance covering:

  • Trip cancellation
  • Trip interruption
  • Medical and hospitalization expenses
  • Emergency medical evacuation
  • Baggage loss
  • Flight delays

6.2 Liability Exclusion

  • The Company is NOT responsible for medical expenses, evacuation, or repatriation.
  • The Client assumes full responsibility for traveling without insurance.
  • Lack of insurance does not exempt the Client from payment obligations.

6.3 Recommended Coverage

Given the nature of our destinations (high altitude, remote areas, adventure activities), recommended minimum coverage includes:

  • Medical expenses: USD $100,000
  • Medical evacuation: USD $250,000
  • Adventure-activity coverage according to the itinerary

 

  1. DOCUMENTATION REQUIREMENTS

 

7.1 Passports

  • Passport valid for at least 6 months from return date
  • Sufficient blank pages for immigration stamps
  • Client is responsible for verifying passport validity

7.2 Visas and Permits

  • The Client is responsible for obtaining required visas for Peru, Bolivia, and Ecuador.
  • The Company may provide general information but does not guarantee accuracy.
  • Clients should consult the appropriate embassies or consulates.

7.3 Vaccination Certificates

  • Certain destinations may require vaccines (e.g., yellow fever for Amazon regions).
  • Clients must consult their country’s health authorities.
  • Some providers may deny service without required certificates.

7.4 Special Permits

  • Certain archaeological sites require advance permits (e.g., Inca Trail, Huayna Picchu).
  • The Company manages these permits but requires accurate client information.
  • Errors in provided information may lead to denied access without refund.

 

  1. HEALTH CONDITIONS AND PHYSICAL FITNESS

 

8.1 Health Declaration

The Client must inform the Company of:

  • Relevant pre-existing medical conditions
  • Medications regularly required
  • Food or other allergies
  • Physical or mobility limitations
  • Pregnancy
  • Any condition that may affect participation in activities

8.2 Altitude Sickness

  • Destinations like Cusco, Puno, and La Paz are at high altitude (3,300–3,800 m.a.s.l.).
  • Altitude sickness symptoms may be severe.
  • Clients should consult their doctor before traveling to high-altitude areas.
  • The Company is not responsible for complications related to altitude.

8.3 Physical Fitness for Activities

  • Some activities require moderate to advanced physical fitness.
  • Clients must honestly assess their abilities before booking.
  • The Company may deny participation for safety reasons.
  • No refund applies for activities not undertaken due to Client decision or safety considerations.

8.4 Medical Attention

  • Access to medical care may be limited in remote destinations.
  • The Client assumes the risks of traveling to hard-to-reach areas.
  • Medical care, evacuation, and repatriation costs are the Client’s responsibility.

 

  1. ITINERARY MODIFICATIONS

 

9.1 Modifications by the Company

The Company may modify itineraries due to:

  • Adverse weather conditions
  • Tourist site closures
  • Strikes or social unrest
  • Safety concerns
  • Force majeure
  • Operational decisions to improve experience

9.2 Equivalent Alternatives

  • The Company will offer alternatives of equivalent or superior value.
  • No partial refunds for necessary modifications.
  • The Company will make maximum efforts to maintain the itinerary’s value and quality.

9.3 Site Closures

Sites such as Machu Picchu or the Inca Trail may close without notice due to maintenance, weather, or government decisions.

  • Alternatives will be offered when possible.
  • No refunds will be issued for closures beyond the Company’s control.
  • Clients are advised to purchase insurance covering such contingencies.

9.4 Extensions and Additional Services

  • Clients may request extensions or additional services subject to availability.
  • Additional costs must be paid prior to service.
  • Extensions do not modify original package cancellation policies.

 

  1. BEHAVIOR AND CONDUCT

 

10.1 Code of Conduct

The Client agrees to:

  • Respect local laws of Peru, Bolivia, and Ecuador
  • Behave respectfully toward guides, staff, and other travelers
  • Respect archaeological sites and cultural heritage
  • Avoid participation in illegal activities
  • Follow safety instructions from guides and staff

10.2 Termination of Services

The Company may terminate services with no refund if the Client:

  • Endangers other travelers or staff
  • Behaves abusively, violently, or in a discriminatory manner
  • Participates in illegal activities
  • Is under the influence of substances affecting behavior
  • Damages third-party property

10.3 Legal Consequences

The Client is responsible for any legal consequences of their actions, including fines, arrests, or deportations. The Company assumes no responsibility or associated costs.

 

  1. LUGGAGE AND BELONGINGS

 

11.1 Responsibility for Luggage

  • The Client is responsible for their luggage and personal belongings.
  • The Company is not responsible for loss, theft, or damage.
  • Travel insurance covering luggage loss is recommended.

11.2 Luggage Restrictions

  • Weight and size restrictions may apply to trains, domestic flights, and certain routes.
  • Clients must comply with restrictions provided in advance.
  • Excess baggage may not be transported or may incur additional fees.

11.3 Valuable Items

  • Traveling with high-value items is discouraged.
  • Use hotel safes when available.
  • The Company assumes no responsibility for lost or stolen valuables.

 

  1. COMPLAINTS AND DISPUTE RESOLUTION

 

12.1 Complaint Process

During the trip:

  • Report issues immediately to the guide or Company representative.
  • The Company will make maximum efforts to resolve issues on site.
  • Document issues with photos or evidence whenever possible.

After the trip:

  • Submit written complaints within 30 calendar days after the end of the trip.
  • Include supporting documentation (photos, receipts, testimonies).
  • Send to the Company’s official complaints email address.

12.2 Response Time

  • The Company will respond to formal complaints within 15 business days.
  • Claims will be investigated impartially.
  • Reasonable solutions will be offered when appropriate.

12.3 Compensation Limitation

  • Compensation is limited to the cost of the affected services.
  • Indirect expenses, lost time, or moral damages will not be compensated.
  • Maximum compensation will not exceed the total amount paid for the package.

12.4 Mediation and Arbitration

For unresolved disputes:

  • Mediation will be attempted through a competent body in Peru.
  • Parties agree to submit to arbitration under Peruvian law.
  • Arbitration is final and binding for both parties.

 

  1. JURISDICTION AND APPLICABLE LAW

 

13.1 Applicable Law

These T&C are governed by the laws of the Republic of Peru, including:

  • Consumer Protection and Defense Code (Law No. 29571)
  • General Tourism Law (Law No. 29408)
  • Applicable INDECOPI regulations
  • Regulations of the Ministry of Foreign Trade and Tourism (MINCETUR)

13.2 Jurisdiction

Parties expressly submit to the jurisdiction of the courts of Lima, Peru, waiving any other jurisdiction that may correspond.

13.3 Competent Authority

For consumer protection matters, the competent authority is INDECOPI (National Institute for the Defense of Competition and Protection of Intellectual Property).

 

  1. PERSONAL DATA PROTECTION

 

14.1 Data Collection

My Peru Destinations collects and processes personal data necessary to provide tourism services, including:

  • Identification data (name, passport, nationality)
  • Contact details (email, phone, address)
  • Payment information
  • Health information relevant to the trip
  • Dietary preferences and allergies

 

14.2 Data Use

Data will be used exclusively for:

  • Reservation management and service delivery
  • Trip-related communication
  • Compliance with legal obligations
  • Sharing with third-party providers necessary for services
  • Marketing (with the Client’s prior consent)

 

14.3 Protection and Confidentiality

  • The Company implements security measures to protect personal data.
  • Data will not be sold or shared with unrelated third parties.
  • The Client has the right to access, rectify, and delete their data.

 

14.4 Consent

By accepting these T&C, the Client consents to the processing of their personal data as described.

 

  1. PHOTOGRAPHS AND PROMOTIONAL MATERIAL

 

15.1 Use of Images

During the trip, Company representatives may take photographs or videos for promotional purposes. By accepting these T&C, the Client:

  • Consents to the use of their image in promotional materials
  • Waives claims for the use of their image
  • May request exclusion with prior written communication

 

15.2 Social Media

The Client authorizes tagging and use of photographs on social media unless an express exclusion request is submitted.

 

  1. FINAL PROVISIONS

 

16.1 Severability

If any provision of these T&C is deemed invalid or unenforceable, the remaining provisions will remain in full force.

16.2 Modifications

The Company reserves the right to modify these T&C at any time. Modifications apply to reservations made after the update.

16.3 Communications

All official communications must be made in writing to the contact addresses provided by the Company.

16.4 Language

In case of translation into other languages, the Spanish version will prevail in the event of discrepancies.

16.5 Entire Agreement

These T&C, together with the reservation confirmation, constitute the full agreement between the parties and replace any prior verbal or written agreement.

 

ACCEPTANCE

By confirming their reservation with My Peru Destinations, the Client acknowledges having read, understood, and accepted these Terms and Conditions in full.
